Founded upon ethnological studies on the concepts of ginhawa (well-being), hanapbuhay (livelihood), and himagsikan (revolution), the paper aims to provide an exploration on the possibility of a Filipino conceptualization of katarungang panlipunan (social justice) that is outside the bounds of Marxist theoretization. This essay insists that although Marxist theoretization of katarungang panlipunan is highly advanced, it is only one among many other possible versions of theorizing katarungang panlipunan. Since there is no concept that is possible to exist in the consciousness (...) without the embodiment of language and culture, the contextualization or critical appropriation of any concept or conceptualization is essential. In the spirit of Filipinization, the study tries to reinforce the position that each culture has its own logic in solving its own problems. It suggests katuwirang bayan as a dynamic translation of social justice, which is often translated as katarungang panlipunan. Katuwirang bayan, which is based upon talastasang bayan (national discourse), is focused on the allocation of ginhawa to the people: hanapbuhay as contemporary pangangayaw for the maintenance of ginhawa, and himagsikan as the manifestation of the people’s bagsik (anger) whenever there is a threat to kaginhawaang bayan (people’s well-being). One of the early propositions on the nature of Southeast Asia comes from George Coedes’ 1968 The Indianized states of Southeast Asia, which assumes that Southeast Asia and its identity construction resulted from the region’s passive acceptance of culture from India and China. Such is the case that that the cultural landscape of the region becomes a mere accumulation of external influences. Robert Redfield’s notion of “great and little traditions” that Southeast Asian historians used in examining and understanding Southeast Asian (...) identity and history influenced these ideas. Zeus Salazar’s 1988 The Malayan connection, challenges this framing of Southeast Asian history. -/- This study aims to evaluate Salazar’s historiographical contributions to Southeast Asian studies, especially in terms of his efforts to problematize and establish the pan-Malayan identity of insular Southeast Asia. This will be undertaken through a critical review of his works such as Kabihasnang Asyano: Isang pangkasaysayang introduksyon [Asian civilization: A historical introduction] (1990); The Malayan connection (1998); Ang Pilipinong banua/banwa sa mundong Melano-Polynesiano [The Philippines in the Melano-Polynesian world] (2006); and, Asya: Kasaysayan at kabihasnan [Asia: History and civilization] (2010), as well as the works of some scholars in Southeast Asian Studies who have been influenced by Salazar and his works. The Hippocratic foursome of sanguine, choleric, melancholy, and phlegmatic survives on the margins of modernity, but its role in moral theory (...) and practice has been largely forgotten. Premodern understandings of human diversity based in climate, temperament, and politics collapsed with the Galenic medical tradition with which they harmonized. Yet temperament continued to be a feature of moral philosophies and philosophical anthropologies even into the twentieth century, and arguably has had a symbiotic relationship with the egalitarian aspirations of modern moral and political thought. This essay surveys the development and practical consequences of the theory of the temperaments developed by one of the greatest prophets of modern values, Immanuel Kant.Temperament was a feature in Kant's course in anthropology from the 1760s until the end of his life. Kant's teachings on temperament are by turns creative and conservative, and bespeak a deep understanding of the logic and rationale of humoral characterology in ethics. But as Kant moves from an ethics based in feeling to an ethics based on the possibility of autonomy, his theory of temperament also changes. In 1764's Observations on the Feeling of the Beautiful and the Sublime, Kant eloquently celebrates the melancholy as the temperament capable of "genuine virtue" (Obs2:217-18/60); by the time of Anthropology from a Pragmatic Point of View (1798), he is commending instead "phlegma as strength" (a variant of a temperament he had earlier dismissed), which can serve as a "substitute for wisdom" (Ant7:290/155). 1 Both of these [End Page 259] positions are distinctive, especially for an eighteenth-century thinker. As we will see, however, they are not without precedent in the tradition of temperament theory. Whether Kant knew he was developing countertraditions of temperament or not, his arguments in each case creatively exploit tensions in the humoral system which go back to its origins in ancient Greece.The mature Kant defended the classic foursome at a time when it had come under fire from many quarters. The early nineteenth century historian of temperament theories Harro Wilhelm Dircksen thought Kant played a decisive role in saving the classical theory from oblivion. 2 Why did Kant think it worth retrieving? Using Jacques Derrida’s deconstruction of Levinas’s other, the paper argues that philosophy’s involvement with nonphenomenality necessarily leads to a discussion of the im/possibility of God. Because the nonphenomenal is proper to God, then the theological trap becomes explicit in the study of philosophy. The paper operates within an exposition of Derrida’s “Violence and Metaphysics,” while arguing in three sections. The first section discusses the theological trap implicit in Levinas and the language that he engages. The limitations of this theological language (...) and the negativity involved in the discussion of the other leads us to consider difference as nonphenomenal. The second section investigates the violence that language entails in Derrida’s understanding of Levinas’s Husserl and Heidegger. This is to demonstrate the point made in section one and to bridge the idea to section three, which investigates the limitations of this language and its implications to any understanding of God as the effect of the trace. This paper analyzes Karl Rahner’s understanding of human freedom and transcendental anthropology. Karl Rahner is one of the most famous Catholic theologian and philosopher of the twentieth century. His transcendental anthropology is a philosophical understanding of the human person grounded in the basic tenets of Christian thought. In relation to this, Rahner speaks of freedom in two ways: categorical and transcendental freedom. By transcendental freedom, Rahner speaks of freedom as an essential capacity constitutive of the human person. By categorical freedom, (...) he refers to the human person’s ability to use the essential capacity of freedom. From this distinction, the author discusses Rahner’s controversial understanding of analogous sin. In here, the author questions the role of freedom and the reality of sin. He concludes by articulating the implications of this understanding of freedom to philosophical anthropology. (shrink)

The article considers Richard Rorty’s thought on pragmatic religion and meliorism. It begins with Rorty’s critique of theism and Platonism, and his attempt to rehabilitate religion using a pragmatist framework. The article then offers an analysis of Rorty’s “unjustifiable hope”. Here, the author distinguishes the differentsenses of unjustifiable hope. With a tension between the “romantic” and “utilitarian” aspects of this outlook, the paper concludes with the advent of Rorty’s pragmatic religion.

This dissertation challenges two myths about Leibniz' Theodicy: that it is primarily concerned with the problem of evil, and that its ethical implications are reactionary. ;Leibniz' neologism "theodicy" connotes not the justification of God, but the justice of God, a justice Leibniz is at pains to make us realize is no different from our own; we are "little gods." This makes God's world-choice a models for an ethics and politics of imitatio dei, and undermines the unspoken "theodicy or ethics" assumption (...) of much modern thought. The purpose of the Theodicy is "edification"--the encouragement of active piety in charity. Not evil but "mistaken notions of liberty, necessity and destiny" are Leibniz' main concern. ;The "best of all possible worlds" argument is a priori, thus insusceptible to empirical confirmation, rejection--or application. Any knowledge of the nature of the actual world is a posteriori, incomplete and fallible. This applies also to our knowledge of "evil" which, while no more than privation, is experienced as real. Language of "privative beings" has its place not in philosophical reflection on evil but in ethics, where the perception of privations defines the sites for action. ;The model for just choice is God's choice of worlds, and the contours of our ethics may be discerned in the way God's antecedent will to produce all goods and prevent all evils results in the consequent will to produce the goods and permit the evils of the best possible world. All antecedent wills survive in the consequent will, so all permission of evil must be attended by regret; only God in His omniscience can transcend regret. We must anticipate God's antecedent wills, not the consequent, and cannot escape regret. ;Leibniz' anti-voluntarist ethics forces us to think of goods in the context of possible worlds, while his understanding of freedom as "indirect" means that action must be understood in concrete and necessarily social ways with reference to the actual world. An archive is an integral part of literate and social life and is in the custody of political institutions for their historical value. It is argued that societies who lack the faculty of recording histories contribute to the archive-making process in a different context. To advance this, the work of anthropologists on the Igorots, more specifically the Kalingas, of the Philippine Cordilleras, and their tattooing practices are considered for heuristic purposes. It is in these societies, where the concept of the (...) Western archive is absent, that the body becomes a repository of significant life events and rituals concretized by tattoos. Tattooing becomes a form of memory on how bodies remember and create narratives and counter-narratives. To serve as a provocation for further research, Derrida’s two-fold understanding of the archive is utilized. The archive, on the one hand, as a commencement that evokes the writing of the archive and, on the other hand, the understanding of the tattoos as disjointed and incomplete, allows us to understand tattoos as a trace. The concept of an operator is used in a variety of practical and theoretical areas. Operators, as both conceptual and physical entities, are found throughout the world as subsystems in nature, the human mind, and the manmade world. Operators, and what they operate, i.e., their substrates, targets, or operands, have a wide variety of forms, functions, and properties. Operators have explicit philosophical significance. On the one hand, they represent important ontological issues of reality. On the other hand, epistemological operators form (...) the basic mechanism of cognition. At the same time, there is no unified theory of the nature and functions of operators. In this work, we elaborate a detailed analysis of operators, which range from the most abstract formal structures and symbols in mathematics and logic to real entities, human and machine, and are responsible for effecting changes at both the individual and collective human levels. Our goal is to find what is common in physical objects called operators and abstract mathematical structures, with the name operator providing foundations for building a unified but flexible theory of operators. The paper concludes with some reflections on functionalism and other philosophical aspects of the ‘operation’ of operators. (shrink)

This study seeks to advance the understanding of controversy resolution in science. I take as a case study conceptualization and treatment of ulcer disease. Analysis of causal accounts and effective treatments illustrate the ways in which competing parallel research programs in medicine embody opposing social, political, and economic forces which are bound to the epistemological dimensions of scientific controversy (e.g., standards of evidence, reference, and inference), and which in turn shift perception of the burden of proof. The analysis illustrates the (...) ways in which (1) medical diagnoses create as much as discover useful distinctions and (2) epistemic and non epistemic values divide scientists into competing research programs, as well as (3) the ways in which these structures often effectively prevent scientific controversy closure. This paper defends an in principle understanding of the authority of persons over themselves and, in consequence, argues for significant limits on morally permissible state authority. It also defends an account of the limits of permissible state action that distinguishes between the ability of persons to convey authority to common projects and what may be judged virtuous, good, safe, or proper to do. In terms of organ transplantation policy, it concludes that it is morally acceptable, and should be legally permissible, (...) for individuals to sell one of their kidneys while living, pocketing the cash to use as that person sees fit to advance their own understanding of their own best interests. Morally objectionable policy proposals, I argue, are not those that encourage individuals to sell a redundant kidney while living or families to sell the organs of a recently deceased loved one, but those that seek coercively to confiscate the organs of the recently deceased. Recognizing the authority of persons over themselves, and their ability to convey moral authority to common projects, including the sale of human organs for transplantation, would shed light on the medical marketplace and clarify public policy, while increasing the efficiency and effectiveness of procuring human organs for transplantation. This paper critically explores key aspects of the gulf between traditional Christian bioethics and the secular moral reflections that dominate contemporary bioethics. For example, in contrast to traditional Christian morality, the established secular bioethics judges extramarital sex acts among consenting persons, whether of the same or different sexes, as at least morally permissible, affirms sexual freedom for children to develop their own sexual identity, and holds the easy availability of abortion and infanticide as central to the liberty interests of women. Secular bioethics seeks to separate children from the authority of their parents, placing children themselves as in authority to make their own judgments about appropriate lifestyle choices, including sexual behaviors. As I argue, however, absent God, there exists no standpoint outside of our own cultural sociohistorically conditioned understanding from which to communicate any deeper perspective of reality or the bioethics that such a perspective would secure. Consequently, rather than discerning moral truth, secular bioethics merely affirms its own particular cultural sociohistorically conditioned ideological perspective. It is a social and political worldview bereft of definitive moral foundation, independent moral authority, or unambiguous content. (shrink)

Many scholars agree that the Internet plays a pivotal role in self-radicalization, which can lead to behaviours ranging from lone-wolf terrorism to participation in white nationalist rallies to mundane bigotry and voting for extremist candidates. However, the mechanisms by which the Internet facilitates self-radicalization are disputed; some fault the individuals who end up self-radicalized, while others lay the blame on the technology itself. In this paper, we explore the role played by technological design decisions in online self-radicalization in its myriad (...) guises, encompassing extreme as well as more mundane forms. We begin by characterizing the phenomenon of technological seduction. Next, we distinguish between top-down seduction and bottom-up seduction. We then situate both forms of technological seduction within the theoretical model of dynamical systems theory. We conclude by articulating strategies for combatting online self-radicalization. The legal basis of informed consent in Texas may on first examination suggest an unqualified affirmation of persons as the source of authority over themselves. This view of individuals in the practice of informed consent tends to present persons outside of any social context in general and outside of their families in particular. The actual functioning of law and medical practice in Texas, however, is far more complex. This study begins with a brief overview of the roots of Texas law (...) and public policy regarding informed consent. This surface account is then contrasted with examples drawn from the actual functioning of Texas law: Texas legislation regarding out-of-hospital do-not-resuscitate (DNR) orders. As a default approach to medical decision-making when patients lose decisional capacity and have failed to appoint a formal proxy or establish their wishes, this law establishes a defeasible presumption in favor of what the law characterizes as “qualified relatives” who can function as decision-makers for those terminal family members who lose decisional capacity. The study shows how, in the face of a general affirmation of the autonomy of individuals as if they were morally and socially isolated agents, space is nevertheless made for families to choose on behalf of their own members. The result is a multi-tier public morality, one affirming individuals as morally authoritative and the other recognizing the decisional standing of families. (shrink)

This study explores the ways in which adolescents, even so-called “mature minors”, lack adequate development of the intellectual, affective, and emotional capacities necessary morally to consent to medical research on their own behalf. The psychological and neurophysiological data regarding brain maturation supports the conclusion that adolescents are qualitatively different types of agents than mature adults. They lack full adult maturity and personal agency. As a result, in addition to the usual requirements for IRB approval, one or both parents, or a (...) legal guardian, should provide informed consent for minor children to participate in medical research. The essays in this issue of The Journal of Medicine and Philosophy explore an innovative voucher program for encouraging kidney donation. Discussions cluster around a number of central moral and political/theoretical themes: What are the direct and indirect health care costs and benefits of such a voucher system in human organs? Do vouchers lead to more effective and efficient organ procurement and allocation or contribute to greater inequalities and inefficiencies in the transplantation system? Do vouchers contribute to the inappropriate commodification (...) of human body parts? Is there a significant moral difference between such a voucher system and a market in human organs for transplantation? This paper argues that while kidney vouchers constitute a step in the right direction, fuller utilization of market-based incentives, including, but not limited to, barter exchanges, would save more lives and further reduce human suffering. Organ procurement policy from the recently deceased recasts families into gatekeepers of a scarce medical resource. To the frustration of organ procurement teams, families do not always authorize organ donation. As a result, efforts to increase the number of organs available for transplantation often seek to limit the authority of families to refuse organ retrieval. For example, in some locales if a deceased family member has satisfied the legal conditions for first-person prior assent, a much looser and easier standard to (...) satisfy than informed consent, organ retrieval may proceed despite the family’s objections. Some countries have replaced voluntary consent to organ donation with forms of organ conscription. Often referred to under the misnomer “presumed consent,” such policies legalize the harvesting of organs at death, unless individuals exercise official options to opt out. As this article explores, however, there are good grounds for affirming the authority of the family to consent to or to deny organ donation on behalf of recently deceased family members, as well as to reject first-person assent and “presumed consent” policies of organ procurement. Insofar as individuals have failed clearly and competently to provide informed consent to organ donation, moral authorization for the use of the person and his body ought to be grounded on the foundational authority of the family, rather than the state’s supposed interests in obtaining organs for transplantation. Creation of for-profit markets in organs for transplantation ignites in many deep moral repugnance. Proposals to broker organs have been denounced by the US Congress and professional groups alike. Financial incentives are believed to undermine consent, coercing the poor into selling their organs, violating human dignity, and improperly commodifying the human body; such concerns are held to trump the possibility of increasing life-sustaining transplants. While such views summarize the apparent global consensus which marks worldwide prohibition of the sale of human (...) organs, I argue that closer examination reveals significant grounds for concluding that markets would be more successful in preventing exploitation, preserving human dignity, and protecting against improper commodification than governmental bureaucratic procedures for procuring and allocating organs. This paper challenges the foundational claim that the human family is no more than a social construction. It advances the position that the family is a central category of experience, being, and knowledge. Throughout, the analysis argues for the centrality of the family for human flourishing and, consequently, for the importance of sustaining family-oriented practices within social policy, such as more family-oriented approaches to consent to medical treatment. Where individually oriented approaches to medical decision-making accent an ethos of isolated personal (...) autonomy family-oriented approaches acknowledge the central social and moral reality of the family. I argue that the family ought to be appreciated as more than a mere network of personal relations and individual undertakings; the family possesses a being that is social and moral such that it realizes a particular structure of human good and sustains the necessary conditions for core areas of human flourishing. Moreover, since the family exists as a nexus of face-to-face relationships, the consent of persons, including adults, to be members of a particular family, subject to its own respective account of family sovereignty, is significantly more amply demonstrated than the consent of citizens to be under the authority of a particular state. As a result, in the face of a general Western bioethical affirmation of the autonomy of individuals, as if adults and children were morally and socially isolated agents, this paper argues that social space must nevertheless be made for families to choose on behalf of their own members. The day-to-day work of clinical ethics consultants and healthcare ethics committees can easily become overly routine. Too much routine, however, comes with a risk that morally important practices will be reduced to mere bureaucratic formalities, while practitioners become desensitized to ethically significant distinctions between cases. Clinical ethics consultation and organizational ethics must be set within the broader social and cultural context of the healthcare environment. This practice requires looking beyond mere legal compliance and the routinely false assumption that there are (...) unambiguous ethical norms that easily govern clinical ethics and hospital policy formation. Together the essays in this issue of HEC Forum challenge readers to rethink taken-for-granted assumptions regarding patient care, physician obligation, clinical ethics consultation, and organizational ethics.
